- Domestic Assault: These charges tend to arise from domestic disputes. In order to be able to claim domestic assault, you must have a certain relationship with the abuser. Often these charges result from an argument which becomes physical. When the police are contacted for a domestic assault case, generally one of the parties goes to jail. Domestic assault can be a very serious charge where individuals are prohibited from entering the home, face jail time, may have limited time with their children and can be prohibited from contacting the other party completely.
- Order of Protection: This is a paper that is signed by a judge to attempt to protect you from an abuser. In order to qualify for an order of protection, there must have been some threat of harm or offensive touching. Consequences for orders of protection are quite severe. They include: getting kicked out of the house, prohibition from owning a firearm, domestic violence classes and specific treatment for drug or alcohol abuse. This type of order is in effect for one year. If an individual violates an Order of Protection, he or she can be put in jail for 10 days.
- Driving Under the Influence: In Tennessee, if you have a .8 percent BAC, you are considered driving under the influence. The state is very strict with regard to this. The penalty for the first DUI is 30 days in jail, alcohol and drug assessment and 11 months of probation. Additionally, there is a fine of $500 and a variety of other costs and attorneys fees.
